Frank's practice focuses primarily on premises and products liability defense throughout the U.S. in both federal and state courts. In this capacity, Frank has represented several New York commercial-property owners and management and maintenance companies in their premises liability litigation, and, primarily, a major European motorcycle manufacturer and an international steel-processing equipment manufacturer in all of their products liability litigation, including asbestos litigation.

Defense Verdict obtained in Construction Accident/Property Damage Case.
In a case involving the collapse of a party-wall onto the roof of the plaintiff's building, we tried and obtained a defense verdict on behalf of the scaffolding contractor that had installed post-accident protection on the roof of the plaintiff's building. The plaintiff had sought over $2 million dollars in damages for actual property damages and damages relating to its inability to enter and use its building. This verdict was recently overturned on appeal, but solely on the grounds that the trial court failed to give a res ipsa charge, and this is despite the fact that the plaintiff's attorney did not even request that such charge be given. We are currently waiting for the case to be returned to the trial calendar.

Pre-verdict settlement for $ 125,000 on behalf of a Bronx building owner in an elevator drop case where the plaintiff elevator-operator never returned to work.
After our cross-examining the plaintiff and his plaintiff-spouse, in a case where the plaintiff-elevator operator suffered bulging discs and related injuries as a result of an alleged 6 story elevator drop, the plaintiff's highly successful and well-known attorney agreed to settle with our client, the defendant-property owner and management company, for $125,000, this after the plaintiff having not returned to work in the 10 years since the accident.

Tried to verdict (post-verdict settlement with two plaintiffs and verdict in favor of all plaintiffs overturned on appeal), on behalf of defendant-property owner and manager, a premises security case involving the death of 6 persons.
Tried to verdict, on behalf of a South-Bronx property owner and manager, a multi-million dollar premises liability case where 6 persons were executed in our client's building due to, among other things, allegedly broken door locks and absent security personnel. While we did not obtain a defense verdict, there was a post-verdict settlement with two of the three sets of plaintiffs for significantly less than the jury’s awards to them and, on appeal, the verdict itself was overturned and the case dismissed.

Settlement of product liability lawsuit in a case involving the paralyzation of one plaintiff and the death of the decedent of a plaintiff spouse and plaintiff minor children.
We represented a prominent motorcycle manufacturer alleged to have been responsible for a motorcycle accident that resulted in the death of one set of plaintiffs' decedent and the paralysis of a second plaintiff. The accident allegedly occurred due to a defective component part in the suspension of the motorcycle that caused the front wheel of the bike to separate from the front fork. After the plaintiffs spent several hundred dollars developing their case, and after we then filed our motion for summary judgment, we negotiated a settlement on behalf of the manufacturer, with all 5 plaintiffs, for a total contribution of $550,000 on behalf of our clients.
