Voluntary Dismissal of Lawsuits Against Resorts
Obtained voluntary dismissals of cases pending in the United States District Court for the District of Maryland, and in the United States District Court for the Northern District of Illinois.

In the Maryland action, the plaintiff was seriously injured on a hotel shuttle bus while on vacation in Jamaica. After moving to dismiss on grounds of lack of personal jurisdiction and forum non conveniens, plaintiff voluntarily dismissed the case rather than oppose the motion.

In the Illinois action, plaintiff's decedent was found floating in the ocean off of the Pacific Coast of Costa Rica. After indicating that we planned to move to dismiss on grounds of lack of personal jurisdiction and forum non conveniens, we were able to obtain a copy of the local coroner's report, which indicated that marijuana, cocaine and barbiturates were found in plaintiff's decedent's system. After providing that report to plaintiff, plaintiff voluntarily dismissed the case before we had to file the motion.

Summary Judgment Requiring Third Party to Indemnify Insured
After settling a serious product liability case, we obtained summary judgment in the United States District Court for the Northern District of Iowa requiring a third party to indemnify our client pursuant to a contract. The case has now been affirmed by the United States Court of Appeals for the Eighth Circuit.
